
Non-Commercial Use Agreement Terms and Conditions
These Terms and Conditions ("Agreement") govern the use of photographs, videos, and other visual content (the "Content") provided by Errbodysaycheese Photography ("Photographer") to the client ("Licensee") for non-commercial purposes. By downloading or using the Content, the Licensee agrees to the terms outlined in this Agreement.
1. Grant of License
1.1. The Photographer grants the Licensee a limited, non-exclusive, non-transferable, non-sublicensable license to use the Content for personal, non-commercial purposes.
1.2. Permitted non-commercial uses include:
- Personal social media posts (e.g., Instagram, Facebook, etc.), provided that the Licensee credits or tags the Photographer as @errbodysaycheese.
- Sharing with friends or family.
- Personal prints or keepsakes.
1.3. The Licensee may not use the Content for commercial purposes, including but not limited to:
- Advertising, marketing, or promoting any business or product.
- Resale or distribution to third parties for monetary gain.
- Use in publications, whether digital or print, without prior written consent.
2. Attribution
2.1. When the Content is shared online, the Licensee agrees to provide credit to the Photographer by tagging @errbodysaycheese on social media platforms.
2.2. Failure to provide proper credit may result in the termination of the License granted under this Agreement.
3. Restrictions on Use
3.1. The Licensee shall not modify, alter, crop, or manipulate the Content in any way that misrepresents the original work, except for minor cropping or resizing for social media posting.
3.2. The Licensee shall not remove or obscure any watermarks, logos, or copyright notices from the Content, unless written permission is provided by the Photographer for watermark removal.
4. Watermark Removal and High-Resolution Versions
4.1. If the Licensee desires the watermark to be removed or requires high-resolution versions of the Content, they must contact the Photographer at dele@errbodysaycheese.com for further arrangements. Additional fees may apply.
5. Ownership and Copyright
5.1. The Photographer retains all ownership and copyright of the Content. The Licensee is granted a limited license to use the Content for personal, non-commercial purposes only as specified in this Agreement.
5.2. No ownership or rights in the Content are transferred to the Licensee under this Agreement.6. Termination of License
6.1. The Photographer reserves the right to terminate this License at any time if the Licensee violates any of the terms outlined in this Agreement. Upon termination, the Licensee must immediately cease all use of the Content and destroy any copies in their possession.
7. Indemnification
7.1. The Licensee agrees to indemnify and hold the Photographer harmless from any and all claims, damages, liabilities, and expenses arising out of any unauthorized or improper use of the Content.8. Governing Law
8.1. This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles.
9. Entire Agreement
9.1. This Agreement constitutes the entire understanding between the Photographer and the Licensee regarding the use of the Content for non-commercial purposes. Any modifications or amendments must be made in writing and signed by both parties.
